Do I need an appraisal for probate or estate taxes?
In Ontario, an estate may require the fair market value of a property as of the date of death for probate (Estate Administration Tax) and tax reporting purposes. The Canada Revenue Agency generally considers capital property to have been disposed of at fair market value immediately before death, although certain exemptions and exceptions may apply.
A formal appraisal is not mandatory in every situation, but an independent residential appraisal can provide well-supported evidence of the property's value at the relevant date. This can help executors, estate trustees, and their professional advisors document the valuation and respond to questions about the reported value.
If you need a retrospective home appraisal for an estate or probate matter, BestHomeValue.ca can help. Your estate lawyer or accountant can advise you on the specific requirements for your situation.
What is a retrospective (date-of-death) appraisal for an estate or probate?
It's an appraisal of what the home was worth on a past date, such as the date of death, rather than today. We use sales from around that date and the home's condition at the time, so it can be done months or even years later.
Is an appraisal different from a realtor's market evaluation?
Yes. A realtor's market evaluation helps set a listing price and isn't held to a professional appraisal standard. An appraisal is an independent opinion of value, prepared under CUSPAP (Canadian Uniform Standards of Professional Appraisal Practice) and signed by a designated appraiser, which is why courts, the Canada Revenue Agency and lenders rely on it.
Will the Canada Revenue Agency, a court or my lender accept your report?
Our reports are completed by appraisers designated by the Appraisal Institute of Canada (AIC) and follow CUSPAP, the professional standard the Canada Revenue Agency, courts and lenders look for. If questions come up, we stand behind the report. For a mortgage, check with your lender first, because many lenders only accept appraisals ordered through their own approved list.
